1. The service
DeadeyeOS provides an operations platform for hospitality businesses: POS and labor monitoring, review management with AI-drafted replies, budgets and reporting, compliance alerts, social publishing, and related mobile and API access. These terms govern your use of the service.
2. Accounts and access
You are responsible for the accuracy of your account information and for the people you invite. Access is role-based; you control which team members can see financial data. Keep credentials and API keys confidential and tell us promptly about any unauthorized use.
3. Subscriptions and fees
Plans are billed per location per month, plus a one-time setup fee stated on the pricing page or in your order. Fees are exclusive of taxes. Subscriptions renew monthly until canceled; cancellation takes effect at the end of the current billing period. Setup fees are non-refundable once setup work has begun.
4. Your data
You own your business data: sales, labor, reviews, budgets, SOPs, and everything derived from them for your account. You grant us the rights needed to operate the service on that data. We do not use your data to train AI models. On termination we will delete or return your data on request, subject to legal retention requirements.
5. Third-party platforms
The service connects to systems you authorize, such as Toast, Google, Yelp, Tripadvisor, Airbnb, Vrbo, ProfitSword, Restaurant365, Sling, Twilio, and social platforms. Those systems have their own terms, and we are not responsible for their availability or changes to their APIs.
6. Acceptable use
Do not misuse the service: no unlawful content, no attempts to breach security, no reselling access, and no use of AI drafts to mislead consumers. Review replies and published content are your responsibility once you approve them.
7. Disclaimers
The service is provided as is. AI-generated drafts, alerts, and compliance suggestions are decision support, not legal, accounting, or professional advice; verify anything consequential before acting. We do not warrant uninterrupted or error-free operation.
8. Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising out of the service is limited to the fees you paid in the twelve months before the claim, and neither party is liable for indirect or consequential damages.
9. Changes and termination
We may update these terms with reasonable notice; continued use after the effective date is acceptance. Either party may terminate for material breach that remains uncured after notice.
